These Terms & Conditions ("Terms") govern your use of our website at alishwebdesign.com (the "Site") and any web design, development, or related services (the "Services") provided by Alish Web Design ("we," "us," or "our"). By using our Site or engaging our Services, you ("you," "the Client") agree to be bound by these Terms. If you do not agree, please do not use the Site or engage our Services.

1. Our Services

Alish Web Design provides website design, development, and related digital services, which may include (but are not limited to) custom site builds, template-based builds, redesigns, maintenance, and consulting. The exact scope, deliverables, timeline, and price for any project will be outlined in a separate proposal, quote, or contract ("Project Agreement") agreed to by both parties. In the event of a conflict between these Terms and a Project Agreement, the Project Agreement will govern for that specific project.

2. Quotes, Proposals & Project Scope

• All quotes are estimates based on the information provided by the Client at the time of the request and are valid for 30 days unless stated otherwise.
• Work begins only after both parties have agreed to the Project Agreement and any required deposit has been received.
• Any requests that fall outside the originally agreed scope (additional pages, features, revisions beyond the agreed number, etc.) may incur additional charges, to be agreed upon before the extra work begins.

3. Payment Terms

• Projects typically require a non-refundable deposit of 50% of the total project fee before work begins, with the remaining balance due upon completion or according to a milestone schedule set out in the Project Agreement.
• Invoices are due within 14 days of the invoice date unless otherwise agreed in writing.
• Late payments may incur a late fee of 1.5% per month on the outstanding balance and may result in a pause of work or suspension of a live site until payment is received.
• Prices for one-time projects are quoted in USD and do not include third-party costs such as domain registration, hosting, premium plugins/themes, stock photography, or licensing fees unless explicitly stated.

4. Client Responsibilities

To keep your project on track, you agree to:

• Provide timely feedback, content (text, images, logos, etc.), and approvals when requested.
• Ensure you have the legal right to use any content, images, trademarks, or materials you supply to us.
• Respond to requests for information within a reasonable timeframe; delays on your end may extend the project timeline accordingly.

5. Revisions

Each project includes a set number of revision rounds as specified in your Project Agreement. Additional revision requests beyond that number may be billed at our standard hourly rate of $30/hour or as a flat fee, to be agreed upon in advance.

6. Intellectual Property & Ownership

• Upon receipt of full payment, ownership of the final, agreed-upon deliverables (the completed website design and custom code created specifically for your project) transfers to you.
• We retain the right to display the completed work in our portfolio, case studies, and marketing materials unless you request otherwise in writing.
• Any proprietary tools, frameworks, code libraries, or design systems we use across multiple client projects remain our property and are licensed to you for use within your website only.
• Third-party assets (stock photos, fonts, plugins, themes) are subject to their own licensing terms and may require separate licenses for continued use.

7. Third-Party Services & Platforms

Our Services may involve integrating third-party platforms (e.g., hosting providers, content management systems, payment processors, plugins). We are not responsible for the performance, security, downtime, pricing changes, or policy changes of these third-party services. Any issues arising from third-party platforms should be directed to the relevant provider.

8. Website Maintenance & Support

Unless a separate maintenance agreement is in place, our responsibility for a website ends upon project completion and final handoff. We are not liable for issues arising from changes made by the Client or third parties after handoff, software updates, hosting issues, or security breaches that occur post-launch. Ongoing maintenance, updates, and support are available as a separate paid service.

9. Warranties & Disclaimers

We strive to deliver high-quality work, but the Services and Site are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that your website will be error-free, uninterrupted, secure, or that it will achieve any specific business result (such as search engine rankings, traffic, or sales).

10. Limitation of Liability

To the fullest extent permitted by law, Alish Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Site or our Services. Our total liability for any claim arising from the Services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

11. Cancellation & Termination

• Either party may terminate a project with written notice. If the Client cancels after work has begun, payment is due for all work completed up to the cancellation date, and any deposit paid is non-refundable.
• We reserve the right to pause or terminate a project if payment is not received according to the agreed schedule, or if the Client fails to provide necessary materials or feedback for an extended period of 60 days, which may be treated as project abandonment.

12. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information shared during the course of the project, and to use such information only for purposes related to the project.

13. Website Use (For Visitors to This Site)

If you are simply browsing alishwebdesign.com, you agree not to misuse the Site, attempt to gain unauthorized access to it, or use it in any way that could damage, disable, or impair its functionality. All content on this Site, including text, graphics, logos, and design, is the property of Alish Web Design unless otherwise noted, and may not be copied or reproduced without permission.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices or for legal reasons. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Maharashtra State/India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Nagpur.
